Terms of Service

TrigPointer helps people discover, explore and log trig points.

The service may include maps, trig point locations and information, search, logged finds, activity history, challenges, achievements, Community features, user-uploaded content and other outdoor-related functionality.

Some functionality is available free of charge and some requires a TrigPointer Premium subscription.

Features may change as the service develops.

TrigPointer is a discovery and logging tool. It is not a safety service, emergency service or substitute for appropriate navigation, preparation and judgement.

Visiting trig points can involve walking in remote areas, uneven or difficult terrain, poor weather, roads, cliffs, water, livestock and other hazards.

Conditions in the real world can change quickly and may differ from information shown within TrigPointer.

You are responsible for assessing whether an activity is appropriate for your experience, fitness, equipment and current conditions.

Where appropriate, carry suitable navigation equipment, check weather and local conditions, tell somebody where you are going, and follow advice from relevant authorities.

In an emergency, contact the appropriate emergency services rather than relying on TrigPointer.

The presence of a trig point on TrigPointer does not mean that you have a legal right to access it.

Some trig points may be located on, near or beyond private property, restricted land, active farmland, military land or areas where access changes over time.

You are responsible for checking access rights, local restrictions, closures, signs and landowner requirements before visiting a location.

Do not trespass, climb fences or gates where access is not permitted, damage property, disturb livestock or enter restricted areas simply because a trig point appears within the app.

Where applicable, users should respect the Countryside Code, local access rules and responsible-access principles.

Information about access supplied by TrigPointer or other users may be incomplete, inaccurate or out of date.

Local signs, lawful instructions, restrictions and actual conditions always take priority over information displayed within the app.

We try to make TrigPointer useful and accurate, but we cannot guarantee that every trig location, coordinate, photograph, description, access note, status or other piece of information is complete, accurate or current.

Trig points and their surroundings can change. Structures can be removed, damaged, inaccessible or incorrectly recorded.

Information may come from public datasets, third-party sources, users or automated processing.

You should use your own judgement and independently verify important information where necessary.

Some TrigPointer functionality requires an account.

You must provide accurate information and keep your login credentials secure.

You are responsible for activity performed through your account and should contact us if you believe your account has been accessed without permission.

You must not impersonate another person or create accounts for fraudulent, abusive or misleading purposes.

You may delete your account using the account-deletion functionality provided within the app.

You must be at least 13 years old to create and operate your own TrigPointer account.

If you are under 18, you should have the permission of a parent or guardian to use the service.

Parents and guardians are responsible for deciding whether outdoor activities are appropriate for children in their care.

TrigPointer allows users to maintain a record of trig points they have visited.

Please record finds honestly.

You must not deliberately manipulate device location, falsify visits or otherwise interfere with features designed to represent real-world trig activity, particularly where those actions affect Community features, challenges or leaderboards.

We may correct or remove obviously fraudulent or technically invalid activity where necessary to maintain the integrity of the service.

TrigPointer may allow you to submit content such as profile information, posts, comments, notes, photographs, reports or other material.

You retain ownership of intellectual-property rights you hold in your content.

By submitting content to TrigPointer, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, resize, display and distribute that content where necessary to operate and provide TrigPointer.

For example, this allows us to store a photograph you upload and display it within the appropriate part of the app.

You must only upload content that you own or have permission to use.

You must not submit content that is unlawful, threatening, abusive, discriminatory, defamatory, deliberately misleading, sexually explicit, invasive of another person's privacy, harmful to children, infringes another person's intellectual property, encourages dangerous or illegal behaviour, or contains malicious code or spam.

We may remove or restrict content or accounts where we reasonably believe these Terms have been breached or where doing so is necessary to protect TrigPointer or its users.

Users should use any reporting tools provided within the app to report inappropriate material.

Some TrigPointer features require a paid subscription.

The subscription period, price and features included will be displayed before you purchase.

Subscriptions purchased through the iOS app are processed by Apple using Apple's In-App Purchase system.

Unless the purchase screen states otherwise, an auto-renewable subscription continues and is charged for each renewal period until you cancel it.

You can manage or cancel an Apple subscription through your Apple Account subscription settings.

Cancelling prevents future renewal but normally allows premium access to continue until the end of the period already paid for.

Refund requests for purchases made through Apple are subject to Apple's applicable rules and processes.

Prices, available subscription plans and included premium features may change over time. Any price change to an existing Apple subscription will be handled in accordance with Apple's rules and applicable law.

Deleting your TrigPointer account does not by itself cancel an Apple App Store subscription.

We may add, change or discontinue functionality as TrigPointer develops.

We will not intentionally remove access to something for which you have already paid during the applicable paid subscription period except where necessary for legal, security or technical reasons.

Temporary interruptions may occur because of maintenance, outages, internet connectivity or services provided by third parties.

From time to time TrigPointer may be made available through TestFlight or another beta-testing programme.

Beta versions are provided to test developing functionality and may contain bugs, incomplete features or other problems.

Features available during testing may be changed or removed before public release.

You should report significant problems where possible, but you are not required to participate in testing beyond using the beta normally.

You must not misuse TrigPointer, interfere with its normal operation, attempt unauthorised access to accounts or systems, introduce malicious software, scrape or systematically extract the service or its datasets without permission, circumvent subscription restrictions, abuse other users or use TrigPointer to facilitate unlawful activity.

You must not use information displayed in TrigPointer as justification for entering somewhere that you do not have permission to access.

TrigPointer's software, branding, interface, original artwork, designs and other material created by us are owned by us or our licensors and are protected by applicable intellectual-property laws.

Third-party maps, datasets, photographs, trademarks and other material remain the property of their respective owners.

Using TrigPointer does not transfer ownership of those rights to you.

You may use the app for your own personal, non-commercial purposes in accordance with these Terms.

TrigPointer depends on third-party technology and services including infrastructure, authentication, maps, payments, subscriptions and diagnostic services.

Those services may sometimes be unavailable or operate under their own terms and privacy policies.

Where you purchase through Apple or use an Apple service, Apple's applicable terms also apply.

We are not responsible for third-party websites or services merely because TrigPointer links to or interacts with them.

We aim to keep TrigPointer available and working reliably, but we cannot promise uninterrupted or error-free access.

The service may occasionally be unavailable because of maintenance, technical failure, network conditions, third-party outages or circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights that cannot legally be excluded under consumer law.

Subject to those rights, TrigPointer is provided for recreational and informational purposes.

We are not responsible for loss caused by your decision to ignore local conditions, signage, access restrictions or reasonable outdoor-safety precautions, or by relying on information which a reasonable person would recognise should be independently checked.

We are not responsible for losses that were not reasonably foreseeable when you began using the service or for business losses arising from personal use of TrigPointer.

Your statutory consumer rights are not affected.

We may restrict or suspend an account where we reasonably believe it is being used fraudulently, unlawfully, in serious breach of these Terms, or in a way that creates a security or safety risk for TrigPointer or other users.

Where appropriate, we will try to provide an explanation and an opportunity to resolve the issue.

You may stop using TrigPointer at any time and may permanently delete your account through the app.

We may update these Terms as TrigPointer changes.

The current Terms will always show the date on which they were last updated.

If a change materially affects your rights or use of the service, we will take reasonable steps to let you know.

Continuing to use TrigPointer after updated Terms take effect means the updated Terms apply to your subsequent use of the service, subject to applicable law.

These Terms are governed by the laws of England and Wales.

If you are a consumer, nothing in these Terms removes any mandatory legal protections available to you under the laws of the country in which you live.
